Overview

These Terms of Service (“Terms”) apply to smashedstudio.com (the “Site”) and to the classes, experiences, products and services offered by Blue Plate Marketing LLC, doing business as Smashed Studios (“Smashed Studios,” “we,” “us” or “our”). By using the Site, booking a class or experience, or making a purchase, you agree to these Terms and to our Privacy Policy at https://smashedstudio.com/policies/privacy-policy. If you do not agree, please do not use the Site or our services.

Age Requirements

Our classes, products and experiences (“Restricted Services”) are intended for a mature audience and are not directed at children. You must be at least twenty-one (21) years old, and fully able and competent to agree to these Terms, to book, access or use the Restricted Services. Individuals under 21 may not use the Site or the Restricted Services and may not submit personal information to us. By booking, accessing or using the Restricted Services, or by accepting these Terms where that option is offered, you confirm that:

  • you are at least 21;
  • you are legally able to agree to these Terms and to any purchase with us and our partners, vendors, agents and service providers; and
  • you have the right, authority and capacity to do so.

We may ask for valid photo ID at check-in and may refuse entry without a refund to anyone who cannot show they are 21 or older.

Bookings and Purchases

When you book or buy, you authorize us and our payment processors to charge your selected payment method for the total shown. Prices may change without notice; you pay the price in effect when you book. Cancellations, rescheduling and refunds follow the cancellation policy shown on each class or experience and our Refund Policy. You agree to give accurate, current information when you book.

Text Messaging (SMS) Terms

Smashed Studios (Blue Plate Marketing LLC) offers text messages about your bookings, orders and questions (the “Text Service”).

How you opt in. You agree to receive texts from us at the mobile number you provide in either of these ways:

  • you text us at (855) 360-7006; or
  • you tick the text messaging box when you book on the Site.

Consent to receive texts is not a condition of any purchase, and taking part is voluntary.

What we send. We send:

  • replies to your messages;
  • booking confirmations, reminders and schedule changes; and
  • notices when your items are ready for pickup.

We do not send marketing or promotional text messages. Texts may be sent using automated technology.

Frequency and cost. Message frequency varies. Message and data rates may apply; check your mobile plan with your wireless provider. We do not charge for the Text Service.

Opting out. Text STOP to (855) 360-7006 at any time to stop receiving messages. You will receive one confirmation text, and no further messages will be sent unless you text us again. Text START to opt back in.

Changes to our number. If we change the number we use for the Text Service, we will tell you. We are not responsible for messages, including STOP or HELP requests, sent to a number we no longer use.

Carriers and delivery. Wireless carriers are not liable for delayed or undelivered messages. To the extent permitted by law, we are not liable for failed, delayed or misdirected messages, errors in them, or actions taken in reliance on them. If you change your mobile number, opt in again with your new number.

Privacy. We handle your mobile number and text messaging consent as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. Continuing to use the Site or our services after an update means you accept the updated Terms.
